Penalties for DUI Third Conviction
Fine:
- $2,000 to $5,000; or
- $4,000 to $5,000 when BAC is over .15 or minor in the vehicle.
Jail:
- Not more than 12 months in jail when third conviction is more than 10 years of second conviction; or
- If third conviction is within 10 years of second conviction, there is a mandatory 30 days in jail.
Probation: Not more than 12 months.
Impoundment of Immobilization of Vehicle:
- 10 days when third conviction is more than 10 years of second conviction; or
- 90 days when third conviction is within 10 years of second conviction.
Driver’s License Revocation Period:
- Third conviction is not within 10 years of second conviction- 6 months to 12 months revocation; or
- Third conviction is within 10 years of second conviction- minimum 10 years revocation. May be eligible for hardship reinstatement after 2 years.
DUI School Level II: 21 hours.
Ignition Interlock Device: Ignition Interlock device is required to be installed in your vehicle for 2 years.
