Penalties for DUI Second Conviction

Fine:

  • $1,000 to $2,000; or
  • $2,000 to $4,000 when BAC is over .15 or minor in the vehicle.

Jail:

  • Not more than 9 months; or
  • Not more than 12 months in jail when BAC is over .15 or minor in the vehicle; or
  • If second conviction is within 5 years of first conviction, there is a mandatory 10 days in jail.

Probation: Not more than 12 months.

Impoundment of Immobilization of Vehicle:

  • 10 days when second conviction is not within 5 years of first conviction; or
  • 30 days when second conviction is within 5 years of first conviction.

Driver’s License Revocation Period:

  • Second conviction is not within 5 years of first conviction- 6 months to 12 months revocation; or
  • Second conviction is within 5 years of first conviction- minimum 5 years revocation. May be eligible for hardship reinstatement after 1 year.

DUI School Level II: 21 hours.

Ignition Interlock Device: Ignition Interlock device is required to be installed in your vehicle for one year. However, when there is a BAC of .15 or higher or passenger is a minor in the vehicle, an Ignition Interlock device is required to be installed in your vehicle for 2 years.
